Husband Ordered to Account For IRA Funds Suspected to Have Been Squandered in Gambling During Marria

Division of Community Property

Attorney Stephen Rocha hedged his client's (Wife) bets by securing order that Husband is to account for funds withdrawn from his IRA during the marriage. Husband cashed out his IRA during marriage but then sought to divide prudent Wife's still existing IRA. Evidence showed that some of the funds had been gambled away which would amount to a claim of breach of fiduciary duty by Wife against Husband in an attempt protect all or a portion of her retirement in the Divorce.
